Labor’s tenth State Budget this year delivered more than just increased debt, a huge deficit and further cost of living pressures to South Australian families.
In this Budget, Labor also sought to introduce changes that will take away some of the basic legal rights of South Australians.
The State Labor Government has tried to prevent innocent people from recovering their court costs after failed police prosecutions.
This means that if you’re accused of committing a crime – even a speeding offence – and you are successful in court, you would still end up having to pay your own court costs.
These changes will certainly make people think twice about challenging expiation notices and minor offence allegations such as property damage. It will be cheaper to pay up even if innocent, rather than contest the charge and have to pay the costs of doing so.
This will also affect the most disadvantaged people in society, who cannot afford to pay expensive legal costs to clear their name.
Not only did Labor try to hide these changes in the Budget, they also made these changes without consulting the legal profession or anyone else.
Instead, Labor should have undertaken proper consultation and introduced a separate Bill in Parliament, so that they could be fairly debated.
Labor has managed the State economy so badly over the last ten years, that they’re trying to save money wherever they can – even if it means taking away some of our rights.
The Government claims that this measure will save $2.8 million per year, but our right to justice and legal protection are more important.
That is why the State Liberal Team has introduced amendments to delete this measure from the State Budget Bill. The amendments are still before the Legislative Council.

There is a legal system in South Australia but no justice system. The "Rule OF Law" went out the window ages ago. Today South Australia is run using "Rule BY law". There is a big difference between the two. Why not look it up for yourself. As a place to start, the Law Society of SA presents a basic summary of the "Rule OF Law" as it's basic priciples.
